1. scope of application of the general terms and conditions
Fantram provides www.fantram.de on the basis of these following General Terms of Use. By registering with Fantram, you agree to be bound by these General Terms of Use and to comply with them as amended from time to time. Section (I) sets forth the Terms of Use, which apply to any user who registers with www.fantram.de. Under (II) are listed the Terms of Use, which apply to "Sellers" in addition to the terms under item (I); and Under (III), the Terms of Use are listed which apply to "Buyers" in addition to the terms under item (I).2. introduction
These following Terms and Conditions govern your use of Fantram and your agreement with us. In the following Terms and Conditions, we refer to our website as "Fantram," even if it is accessed through the URL www.fantram.de. Furthermore, references to "we", "us", "our" are to the operators of Fantram. "Content" is called any material created by a Member (be it a Seller or Buyer) on Fantram, be it photos, videos, links, text, metadata, emojis or any other data that a Member might create and/or upload on Fantram. "Seller" means a Member who posts "WishList Items" on Fantram that can be viewed or purchased by other Members. A Seller also means anyone who charges for private chats. "Buyer" (which may also be referred to as "Fan") means any Member who purchases "WishList Items" from another Member or who pays fees for private chats. Any "Member" may be a "Seller", a "Buyer", or both at the same time. A "seller-buyer sale" is called any transaction that can take place between a seller and a buyer, in one of the following ways: Buyer purchases WishList items from a Seller. Buyer pays fees to send private messages to Seller ("private chat") Buyer sends "tip" to Seller "Terms and Conditions" means the legally binding terms and conditions that apply to each user of Fantram (i), which additionally apply to Sellers (ii) and which additionally apply to Buyers (iii), the General Community Policy (iiii), the Privacy Policy (v) and the Complaints Policy (vi). "Member" means any user of Fantram, whether a Seller or Buyer, or both. (hereinafter also referred to as "you" or "your"). Any part of these TOS and Terms of Use set forth herein may be changed at any time to comply with, for example, legal changes or regulations of governmental authorities, or to address a threat to all Members from viruses, spam, fraud, data breaches, or all similar and other potential dangers and risks to our Members and us, which, due to the urgency of such action, does not allow us to provide you with prior notice of such changes. We may also change any other part of the TOS and Terms of Use for any reason at any time and will notify you of such changes in a reasonable manner, by email, on the home page of Fantram, or as a private message from us on Fantram after the fact. You may then terminate your membership with Fantram if you do not wish to accept the TOS. Continued use of Fantram and its services after being informed of Fantram's modified TOS/Terms of Use automatically means acceptance of them. Likewise, we may make changes to Fantram of any kind. We may also disable Fantram and its services at any time, for no particular reason. We will attempt to provide reasonable notice of any such major changes. Further, we will not guarantee that the www.fantram.de website and its content/functions will be available at all times, without interruption.Registration with Fantram: In order to become a member of Fantram, you must first register and create a user account at www.fantram.de/users/register. (1) To create this account, you must provide a valid email address and a secure password (our login screen will tell you if your password does not meet the requirements). Also, when registering, you must provide a free username, which means a username that no other member of Fantram has chosen yet. Furthermore, you must be at least 18 years old to become a member of Fantram. If the laws of the country in which you live provide that you can only be legally bound to a (purchase) contract if you are older than 18, you must be old enough to be legally bound to a contract with us under the laws of the country in which you live. You must provide any further information or proof of your age/yours that we request, if we request it. If you do not meet the above requirements, you may not use Fantram. If you have registered an account with Fantram in the past, please assure us that this previous account has not been terminated or suspended by us because you have violated the terms and conditions stated herein. 3. service description of the Fantram platform
3.1 Fantram provides a platform on the Internet under the domain www.fantram.de, which provides artists, musicians, models, etc. (hereinafter referred to as "sellers") and "buyers" (fans) with various tools and functions, including: Creating a WishList: this WishList can contain products from any possible online store (except items from Fantram itself). After the Seller has registered on the Platform (1), the Seller has the possibility, at www.fantram.de/create/ws, to create a "WishList Article" by inserting a link to a "Wish Article" from another online store in the form displayed at www.fantram.de/create/ws in the "Article link" field. Furthermore, the seller can add a title, a note and possible (important) other information (e.g. size or similar) of the online store article to the WishList article, also using the form mentioned in the previous point. These WishList items can be "donated", i.e. purchased, to the sellers by other members. In the further course called "Member buys the WishList item of a seller".
"Fans" can "suggest" items to sellers by the fan providing a link to an item of an online store and (optionally) a note on the seller's profile via the "Suggest item" button. This suggestion is then forwarded to the seller. The seller can accept this suggestion if the seller wants to. If a seller accepts a fan's suggestion, the suggested item is added to the seller's WishList items, the fan receives feedback, and can then purchase this new WishList item from the seller. A suggested item from a fan can be added to the seller's profile ("WishList") after the seller accepts it. When a member purchases a seller's WishList item, Fantram automatically creates a private "chat", between seller and fan only, in which: Seller and Fan via. Communicate via text messages, or send pictures to each other. Seller and fan receive information from Fantram about the status of the purchase and shipment of the "donated" item(s) Seller and Fan will continue to have the ability to communicate about the item(s) for 48h (counting from the time Fantram notifies the Seller that the item(s) has been delivered) from the time of order confirmation until after the item(s) has been delivered to the Seller. For example, the seller can send pictures of the item(s) received to the fan. Donating", "buying" WishList items is also possible without a registered account with Fantram. The respective sale then takes place "anonymously", the seller does not receive any further information about the buyer. However, the buyer can send the respective seller an optional private, anonymous message - per individual item. This is done before the "checkout", i.e. the last step before the order is completed.
4. registration requirement
Certain functions of Fantram can only be used after logging in (registration) - as described in the first part of these GTCs. Anyone who provides true, accurate, current and complete information about themselves in accordance with the registration form can become a member. The user is obliged to adjust this registration data immediately after a possible change. The member has to keep the user data secret from third parties. If it is found that the user data is not correct, the user has the right to block or delete the user account. The registration is not divided into seller and buyer (fan). Each member can be either a seller or a fan, but also both. A member automatically becomes a seller by the member creating a WishList item. A member becomes a "fan"/"buyer" when the member "buys" a WishList item from another member. So each member can have their own WishList items linked to their profile, but at the same time buy other members' WishList items.5. Imprint
